WAIVER OF LIABILITY AND INDEMNIFICATION

By participating in any general performance, master classes, concert, or competition organized by MusicNBrain, hereinafter referred to as the "MusicNBrain Events," the participants and their representatives ("Participant") agree to the following terms:

1.1 Waiver of Liability:

The Participant hereby waives, releases, discharges, and covenants not to sue the MusicNBrain Event Hosts, its owners, employees, judges, agents, or representatives (collectively referred to as "Releasees") from any and all liability, claims, demands, losses, or damages arising out of or related to the Participant’s participation in the MusicNBrain Events.

1.2 Indemnification:

The Participant agrees to indemnify, defend, and hold harmless the Released from any and all claims, demands, losses, attorney's fees, costs, liabilities, or damages against the Releasees arising out of the Participant’s participation in the MusicNBrain Events.

MEDIA CONSENT

By participating in the MusicNBrain Events, the Participant consents to and authorizes the MusicNBrain Events to use their submitted video-audio recordings or any other materials of the Participant’s performances without any compensation to the Participant. This includes but is not limited to publication on local media, social media, digital streaming online, and for marketing purposes. The Participant agrees to waive and release any and all claims they may have against the MusicNBrain Events relating to the use of these recordings or any other materials. This consent is binding upon all heirs and future legal representatives. In the event that a minor child is selected as a winner of this MusicNBrain Events, the Participant agrees to identify the child by full name with a video recording.

DATA POLICY

The Participant acknowledges and agrees that any personal information collected will be subject to the MusicNBrain Events Privacy Policy.

DISPUTE RESOLUTION

In the event of any dispute, claim, or disagreement ("Dispute") arising from these Terms and Conditions, the parties shall make their best efforts to resolve the Dispute. The parties shall consult and negotiate in good faith, recognizing their mutual interests and attempting to reach a just and equitable solution satisfactory to both parties. If a mutually acceptable solution is not reached within sixty (60) days, either party may give notice to the other, and all Disputes shall be finally settled through arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitrator's award may be entered into any court with jurisdiction.

These Terms and Conditions constitute a binding agreement between the Participant and the MusicNBrain Events. By participating in the MusicNBrain Events, the Participant acknowledges that they have read and understood these Terms and Conditions and agree to be bound by them.
